Protest against government politics that violate fundamental rights of the Amazon peoples.



NATIVE FEDERATION OF MADRE DE DIOS:
Decree regional strike from 13 April 2009, in protest against government politics that violate fundamental rights of the Amazon peoples.


The indigenous organizations and organizations who represent the agriculture, mining, Brazil nut and small scale logging sectors, as well as all of the organizations who make up the Alliance of Federations of Madre de Dios, took to the streets to protest against the constant aggressions of the Peruvian government with politics that violate the fundamental human rights of the Amazon peoples. The popular measure of a strike for an indefinite time period was started on the 13 April 2009, demonstrating solidarity with the larger National strike in the Amazon, which was started on the 9th April in other regions of the Peru.

The president Alan Garcia is establishing a state politic which is supposed to “modernize” the country looking towards the free trade agreements with the USA, but in reality this is only another chapter in the long history of displacement of native peoples, rural farmers, Brazil nut collectors and small scale loggers from their lands; finally opening up our ancestral lands, the lungs of the world, to groups with economic powers. This situation arises, despite the fact that a report from the Multipart Commission (set up by the Congress of the Republic) which was installed last year July and August after a National strike in the Amazon, recommended that the derogation of these legislative decrees which endanger the life of the indigenous peoples of the Amazon.

The desperate attempts by the government to satisfy the expectations and requirements of the economic sectors with power at the national and international level, is motivating them to install unconstitutional measures which are rejected by the Peruvian population, and the national and international organizations who defend human rights.

Some of the legal bases which are being contested in this strike are the legislative decrees 1089 which creates a temporary regime to formalize and title rural lands under the government office COFOPRI, who will employ distinct mechanisms, in which they will title only land which has been worked (or deforested) rather than the totality of the area that the owner has conserved as intact rainforest; the legislative decree 1090 which excludes the rainforest resources from the national patrimony and represses the regional autonomy of the provinces; legislative decree 1064 which replaces the law 26505 and by so doing violates the rights to property, which will affect owners of titled land and native communities; the legislative decree 1020 which imposes a development model, which encourages parceling (dividing up) of communal lands and endangers the integrity of the property owned by native peoples; the legislative decree 1080 which opens the doors to transgenic seeds, which in itself will generate dependence; the legislative decree 1060 which degrades the intangibility of the patrimony predial of the INIEA put in place by the law 28573.

The law 29338, which excludes the use of hidrografic resources (water) by native communities and rural farmers, and does not declare as intangible the headwaters of the rivers (most important parts of the rivers).

The Supreme decree No. 19-2009-MEM which is orientated at the paralization of the gold mining activities.

Yesterday, 13 April 2009, we attended a reunion with the local authorities of Madre de Dios in the city of Puerto Maldonado, to discuss themes related to the platform for the strike in the regional context. The local government promised to set up small comissiones to investigate the different demands put forward in order to resolve the problems and end the strike that the native communities are realizing. Against this reality and the lack of leadership and urgency on the part of the local authorities to attend the proposals given forward by the social and productive sectors of the region, as well as their incapacity to manage effectively the plans and regional development programs, the organizations of Madre de Dios continue the protest and we are not going to allow this, or any other government to violate our human rights and endanger our existence, on the contrary, we are united now more than ever to defend our right to our lands and ancestral territories, and our fundamental human rights to life, water and to a choice in our development.

Considering this we pronounce:

FIRST: THAT THE REGIONAL INDIGENOUS STRIKE FOR AN UNDEFINTED TIME PERIOD, STARTED ON 13 APRIL 2009 CONTINUES.

SECOND: WE INVITE THE UNITY OF THE REPRESENTATIVE ORGANIZACIONES, THE BASE ORGANIZACIONES, THE PROFESIONAL COLLEGES, THE SINDICATES OF MADRE DE DIOS AND CIVIL SOCIETY ON A NATIONAL AND INTERNATIONAL LEVEL, TO SUPPORT OUR PEACEFUL STRIKE.

THIRD: WE CALL ON THE MEDIA, REGIONAL, NATIONAL AND INTERNATIONAL TO INFORM ABOUT THE LONG STANDING FIGHT WHICH WE ARE UNDERTAKING.

FOURTH: THE DEFENSE OF OUR RIGHT TO THE INTEGRITY OF OUR LANDS AND THE LIVING CONDITIONS OF OUR PEOPLES.



WE DEMAND THAT THE REGIONAL AND CENTRAL GOVERNMENT PAY ATTENTION IN ORDER TO RESOLVE THE PLATFORM FOR THE STRIKE AND WE ENCOURGAE AN OPEN DIALOGUE.
